BUSINESS POLICIES
Any agreement for the purchase of goods and/or services from
Millennium Information Group, Inc. ("MiG") shall be
governed by and is made subject to these Business Policies and
the Returns Policies stated below (collectively, the "Policies").
MiG may, at its sole option, revise the Policies from time to
time without notice. Prices and availability are subject to
change without notice. Photos may not represent actual product.
Typographical, product description, pricing and other errors
are subject to correction, even after orders and/or payment
are accepted. Manufacturer warranty, if any, applies; MIG HEREBY
DISCLAIMS ALL OTHER WARRANTIES, INCLUDING BUT NOT LIMITED TO
WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
MiG does not guarantee product compatibility. Not all products
are eligible for return, and not all products that are eligible
for return are to be returned to MiG. Carefully review all return
policies (below) before making your purchase. Shipping charges
are not refundable.
Governing Law
Any purchase of goods from MiG shall be governed by and construed
in accordance with the laws of the State of New York, without
giving effect to any principles of conflicts of law. Those who
choose to access this site from other locations do so on their
own initiative and are responsible for compliance with local
laws, if and to the extent local laws are applicable. Except
for equitable relief sought by MiG, which may be sought in any
court of competent jurisdiction, user consents to the exclusive
jurisdiction of the State and Federal courts located in New
York, New York.
Limitation of Remedy
IN NO EVENT SHALL MIG BE LIABLE FOR ANY DAMAGES CAUSED BY ANY
PRODUCT OR SERVICE OR THE FAILURE OF SUCH PRODUCT OR SERVICE
TO PERFORM, INCLUDING BUT NOT LIMITED TO ANY LOST PROFITS, LOST
SAVINGS, LOSS OF USE, LOSS OF DATA, OR ANY OTHER SPECIAL, INCIDENTAL,
INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER OR NOT
ADVISED OF THE POSSIBILITY OF SUCH DAMAGE, AND REGARDLESS OF
THE THEORY OF LIABILITY PURSUANT TO WHICH SUCH DAMAGES MAY BE
SOUGHT. MiG is not liable for any claim made by a third party
or made by you for a third party.
MiG obtains certain data directly from the manufacturer or distributor
of certain products. While MiG makes every effort to ensure
the accuracy of this data, this web site could include typographical
errors and/or technical inaccuracies. MiG reserves the right
to make improvements and/or changes to such data and/or this
web site at any time. MiG makes no warranty of any kind with
respect to the data on this web site or the accuracy of advice
given by MiG employees, whether or not such advice is made in
writing.
Customer's responsibility for certain shipping charges
If customer requests shipping charges be paid either on a collect
basis or on customer's account with the shipping company, and
customer refuses the shipment or refuses to pay the applicable
shipping charges, MiG may bill customer, and customer shall
pay MiG, for all resulting charges incurred by MiG either directly
or through its supplier. In all instances where customer requests
shipping charges be paid either on a collect basis or on customer's
account with the shipping company, customer shall assume risk
of loss or damage to the product during shipment; MiG strongly
recommends customers obtain insurance for such shipments, as
neither MiG nor its suppliers will insure such shipments.
